I got the GTI splitter fitted, looks very nice :)

As for the refund of the old splitter...
I was about to drive to their house, so I rang them first.
I said I was about to come and return the item, and the man went on about how he had taken his 1999 Polo to a garage to have it fitted, and they said it's not for the car. He said that they said it is for the next model up (which would be 00-01) and he said he is 100% sure about this.
I told him that the model number confirms that the item is for the model before mine (1999 and previous).
He went on to say the same thing he just said about the garage and repeated himself continously going over the same point (a sign that he's trying to persuade me that it is for my car, obviously because he doesn't want to refund the money). Within his long speech, he said if he had a written confirmation that the item was not for my model, then he would refund the money.
So after his speech, I asked him if I get VW to tell him that it isn't for my car, will he refund the money. He took a 5 second silence. Then he started saying that he has a friend who has an X reg Polo, and that he tested the item on that car, and that it fitted perfectly (blatantly a lie!). I asked him 2 more times, and he wouldn't give a yes or no answer, and kept trying to defend his case (e.g. "well the garage said...").
Clearly he does not want to give a refund, so I guess my only option is to give a negative feedback and report him to eBay, then try and sell the item to get my money back.

Or go round there with a few mates  .

If I was you I'd get VW to give you a headed letter saying it's not for your car then take it to him and say there you go, give me a refund or I'll take it further.

Either E-Bay or the Police.

I didn't want to suggest that incase he does, that way I am in no way responsible.

Just for the Courts it was Toby's idea

Hehe

At the end of the day the seller should cough up as he mis-sold the splitter, whether intentionally or not. Get the VW headed letter or even better take the guy to the nearest VW garage, give them the part no and they can show him on etka that its for the older model vehicle :)

The seller sounds like a right gibbon, its not hard to do the refund and relist it on eBay with the right info is it now? What a cock :x

Lol. Thanks for the replies.
I've given him once last email with the number of VW Parts so he can ask them for himself. I also gave him a link to a website which states that the part is for 95 onwards Polos.
I warned I would open an eBay dispute and leave negative feedback, so I'll wait for the reply.
If he doesn't comply, then I'll get the letter and go to his (with friends in the car lol) and demand a refund.

Did you pay with PayPal? File a complaint with them, "goods not as described" or something, pointing out the wrong year info in the auction and dodging telephone manner etc... say you have checked with the dealer parts dept as well

I paid in cash unfortunately...

They sent me a message today:
-----------
hello again, as i have stated to you before that the spoiler was oringanlly bought for a year 99 polo but didn't fit because it was for a year 2000 onwards this was fitted at a garrage who deals with vw so why wolud they say it's the wrong model, and will fit a yeat 2000 so i am sticking to my advert which i know was advertised right. if you feel you need to leave bad feedback thats up to you yours caroline
-----------

I replied:
-----------
I know this is not only about the hassle of having to auction this item again. It's also about the money. But don't worry, it's okay, I know that you will go to any lengths as to steer clear from a refund. To make up a lie about having a friend with an X reg who successfully fitted the item on, is comical.
You can stick with your defense statement about the garage saying that it is for 2000 and onwards Polos, but that's nothing against the fact that VW themselves confirm that this item is for 1999 and previous Polos... now ask yourself why would THEY lie?
Just as long as we both know that you're wrong, I can happily resell this item and get on.
-----------

I guess I will sell this item on, no biggie. After all, karma from the world of My Name Is Earl will get them
