I took the car into my local VW dealership today and someone took the car out for a quick drive and they've acknowledged there is a problem changing up in to 2nd gear.
However they're telling me if when they take the gearbox off and split it down and find it is due to wear and tear then i'll have to pay the labour cost for them to take the box off and look at it and then then on top of it i'll have to pay the repair.
They'll only foot the bill if something has actually like broken off is what they're telling me
What the hell am i supposed to do?
My warranty runs out in 16 days too

sounds like a lame excuse to me, wear and tear? yeah prehaps if you've done about 100,000 miles!

Only 23,000 miles on it, so not alot really for a 3 year old car!
When I got in from the VW near me I rang up Wayside VW in MK which is where I got the car from and they're ringing me back in the morning. Hopefully they'll be a little more helpful.
What sort of stuff can I say to sway them towards sorting it lol?
I tried to explain to the VW near me that it never gets driven hard in lower gears (but my word counts for nothing eh?) and also that a part like this shouldn't really wear at 23,000 miles on a 3 year old car.

Also, if it is just the 2nd gear syncro mesh, do they just replace this or do they change the whole gearbox?
I was promised a phonecall last night from VW MK, when i rang up last night to say i hadn't got one, i was promised one first thing this monrning. It's now 12.30pm and no phone call.
So I'd be able to get it sorted at JCT under warranty for sure mate?

Car is booked in for end of March, earliest i could get booked in because i need a courtesy car .
They're going to inspect it etc and tell me what the actualy fault is free of charge and also decide whether or not it is down to wear and tear or not. Better than my local VW who said they'd take the gearbox off and decide whether or not it was down to wear and tear and leaving me with a huge bill before the car was even fixed.
If they decide it is down to wear and tear, what the hell am i supposed to do??? Only 3 years old with 23,000 miles on it and i don't even drive it hard, not in lower gears anyway.

Wayside VW in Milton Keynes mate. I'd happily come up to where you work if you could get me in and have it 100% done under warranty . It'd be greatly appreciated mate :p

i dont do the booking in just the fixing ive yet to see a gearbox we have stripped under warranty then said it wasnt covered and charged it back to the customer

Fair enough mate. If it's the 2nd gear syncro that's gone, what gets replaced?

Now the remap is off I'm having no problems with the gearbox, really annoying
