WITHOUT A TRACE.... I go mad...

GO CRAZY... CALL THE POLICE... report the car stolen.... and then get told by the police to call the yard. They say it might have been taken by the council...and try calling the compound...

they give me a number...

i call the number...

and those cheecky council f uckrz have taken my car....

Im relieved my car isnt stolen.. but then find im still getting robbed as i have to pay £260 to get my car out.....

Just for parking in a permit holder bay that said 6.30 on one side of the road and 8.30 on the other. I unlucky choose the wrong side of the road.. anyone know if i can take this to court and get away with it????????

What grounds are you going to take legal action on?

From what I can understand, you parked in a permit holder space when you shouldn't have. Unless you can somehow prove that it wasn't made clear that the space you parked in was restricted, then quite frankly I can't see what case you have.

Thats exactly it... i dont think i can take it to court and appeal the action... but its just pissing me off that all it took was 15 mins and they had started towing the car.

I was wondering if anyone knew a loop hole in the law so i could take it to court and win???? (I very much doubt it.)

It really all depends on what regulations that borough council has on removing cars parked where they shouldn't be.

Only way you could really contest it is if they didn't follow the correct procedure ie. didn't wait long enough before removing it.

Even then bringing a court case will cost time and money, and if you lose you can end up paying the costs of the other side.

I saw this program the other day... ( this is gona be one of those stories.)

But if you look online theres this guy you can pay to find a loophole but usually what he does is measure the parking pay or something like that and if its not regulation size then its not a legal parking space therefore meaning you have not broken nor infringed any parking laws.

Just a thought.

Worth looking up though he went round london for half an hour showing how like only 1 in 100 parking bays are correct size etc.

there is no loop hole. your just unlucky because in about 3 months there changing the law so that they cant tow your car, or place fines or wheel clmaps unless your a regular affender or longer than 15 minuits.

unfortunelty, your just unlucky mate. iv herd of this story before by my dads mate. you could try going to court, but playing with the council wouldnt be advised lol. youll lose. unless you keep prosponing it..and the judge gets pissd off and jus throws it out...

Not 100% relevant to this but you can get clamping fines returned etc so long as you were not aware of any signs saying that you cannot park there. What I mean is if they have like one sign that can only be seen, or no signs at all then the messae you cannot park and the consquences of parking cannot have been made known to the person.
Thi happened a while ago in a car park near my uni. One day they decided they didnt want the students parking there and they clamped loads of cars totaling about 2 grand in fines. But because it was such a sudden thing they had not put any signs up telling people about this.
Since there were no signs, this resulted in the action of putting a clamp on the car being seen in the eyes of the law as trespass to a vehicle, and meant that everyone who had been fined got every penny back
