Hit by an Uninsured Driver . . .advice?

Well today my baby got its first ever injuries.

I was going round a round about and got onto the road of choice . . then as I pass a woman parked on the footpath she pulls out into the side of me.

I'm furious - my mum, sister and 6 month old foster baby were in the car and now my beautiful Polo is scratched. :(

I phoned up Quinn direct (mine and the stupid womans insurance) and they told me her policy was cancelled on the 10th of March so she's uninsured. The man at Quinn gave me a claim number and told me to visit a workshop but I don't know how they are going to get money when her policy has been cancelled. Does anyone know how this works? . . .he mentioned a Bureau or something. How long do you think it will take to get the claim to fix the car. :(

Theres legal implications for her, as shes driving a car without insurance, so it might be wise to speak to the police, as shes breaking the law!

As for getting the money for the claim, if she has no insurance, unless you can battle it, you may have to claim so im not too sure on a timescale :(

gutted for you mate, i dont know why uninsured drivers get away with it!! i think a harder punishment is required!!!!

Bad enough that some gaumless git pulls out into you... but then that have no Insurance makes it all the worse....

Solutions...

1. Claim off your own insurance, loose no caims, be punished on premiums for 3-5 years but car is fixed..
2. Get car fixed with your own money, dont make a claim, and leave all insurance benefits intact..
3. Leave car scratched and dented and just put up with it and again dont claim...
4. MAKE HER PAY for the repairs outside of insurance claims...
5. Point 4 failing - hire some heavies - to MAKE HER PAY....

So you might get my point here.. MAKE HER PAY .. it would be cheaper for you to MAKE HER PAY... dont just roll over .. she was wrong... and despite what some might think.. in some cases TWO WRONGS DO MAKE A RIGHT....

There are plenty of low lifes out there that will do almost anything for fifty quid ;-) if you know what I mean....

Of course I dont condone, endorse or recommend any of the above behaviour/suggestions- just what I heard was what some people might do in such circumstances....

best thing to do now is, report her to the police, she will get done for driving whilst uninsured, she will be found guilty.....then use your legal aid on your car insurance, and go through the courts, as she was found guilty of driving without no insurace, she will be also need to pay costs to damages

cos claiming on your legal advice doesnt affect your no claims ....

will take lots of time.... but you will leave your insurance intact!

Thanks guys. I've a protected no claims bonus so I don't think its going to cause a rise in my renewal quote (indeed I asked Quinns would it and he said "No").

I hope it get's sorted easily and quickly and that the "grace period" after policy cancellation covers the damage. I'm off to a body shop tomorrow and I'll give some figures and what needs done.

Nobody is injured though and it's not even in the same ball park in terms of being as bad as the White Polo GTi's damage so I'm very lucky I guess. :)

be careful when they say "no" they will sting you on a "general price increase mr so an so......" and the fact that youve had an accident too

i don't know if this works in the uk, but here in romania it does. try talking her into paying for your repairs without going to the police. im sure she doesnt want to get in trouble with the police.

Seconded. I would speak to her about what level your capable of taking it to with her, and I'm sure she'd rather pay for your car to get fixed out of her own pocket then pay more in the long tiring run of court etc whilst most probably also facing something on her record.

If that fails put up with teh damage for now and take her through the system. She won't get away with it, and it's definitely not worth coming out of your own pocket or insurance.

f**k uninsured drivers! i had a drunk with no license pull out in front of me, i went flying into the side of him at 50mph down the carriageway. he tried to make a right turn into a no entry road where there were blatantly "no right turn" signs. bastard. :cry: if the guy has insurance, i will get covered but i doubt he has any since he doesnt even have a license. so the insurers bureau will have to cough up the money. the front of my polo (4 months old) is mangled :( she still works tho, electrics and all tough little motor. such a pain in the ass.

go to her home with some big lads, pretend its baylifs say we are here to collect moneys to the sum of £x if you cannot pay we will remove goods from your home to that value! she will sh1t it and pay! failing that do her house windows one night!
