MOT's and scrubbing

I was just having a look on a website about MOT tests and found this is one of the criteria:

2. Check tyres for fouling a part of the vehicle.....

So does this mean those of us who have had scrubbing from lowering could fail an MOT?

My tyres foul the arches slightly, and I do get a bit of rubbing here and there on the back. However, the car passed its MOT in July, even because of this.
