Silencer a MOT requirement?

Quote below came from an MOT info website. Doesn't say you HAVE to have a silencer, although the noise COULD be deemed excessive if you didn't.
Plus PC Plod could give you a hard time for excessive noise.

The exhaust system will fail the MOT if:

Part of the system missing or excessively deteriorated
A mounting is missing or damaged so it does not support the system
There is a major leak
The system is excessively noisy.

Yea I contacted the DVLA they said its fine just aslong as the garage doesn't think the noise is excessive during an MOT.
