MPV went into the side of me - Complications....

Right. I was hit today by a mother in an MPV. She's admitted liability, and I have impartial witnesses to work with who said it was her fault.

My problem is this. Once i got home, i checked through all my documents, and realised my MOT was due on friday. Does this screw things up? Any help on where I stand would be appreciated. Car may be a write off, there's a small impression in the roof which wasn't there before.... Will get pics up as soon as I find a camera!

RIght - car went in for its MOT this morning. Hopefully I'll hear good news back. In the meantime, here are a few photos to keep you all entertained..

This might be a bit difficult to see, as it's almost impossible to get on camera, but there is a slight impression in the roof directly above the dent:

The wheel still rolls fine, as i drove the car home after the incident. Any help on the legal side of things would be greatly appreciated, along with diagnosis..

Her insurance may ask to see the MOT and Tax to see if your car was worthy of being on the queens road a the time of accident. It's one of their small ways of rejecting your claim however, i've only ever been asked for it once.

As long as you all got out with no injuries, thats the main thing!

Unfortunately for the Polo, it looks a write-off to me. Being a 3-door, & where you've been struck plus the value of the car, may make the insurance company say its un-economic to repair. :?

Verdict back from the garage, failed the MOT. Emissions were a little dodgy. Plus the impact has knocked the body off the chassis. Write off it is.

Hmm.. would arguing that you was driving to the garage to get it MOT'd be a valid statement in this scenario?

I would still contest that not having MOT doesn't mean she has a right to hit you and that you are still not at fault.

NOZ I'm curious, does that mean if your MOT runs out say midway or before your road tax and insurance runs out, that your car isn't road worthy? *scratches head*

It might, except I wasn't in my village at the time, i was in the next town. May be a possible arguement. Thanks for the idea. The MOT didnt pick up anything structural that wasn't due to the accident, just emissions, a dodgy seatbelt, sidelight needing replaced and a bad handbrake.

I don't see those faults can cause your car being hit so I'd say by logic, they cant argue the expired MOT.
But lawyers don't use logic... they only see £ signs LOL
