Gearbox issue 2015 polo

Hi, I bought my polo in march 2021 from VW themselves. The car came with 2 years warranty. In december last year, within 9 months of owning the car i noticed an inconsistent whine when sitting in lower gears (usually after sitting in 5th). I had VW check it and they said that it is coming from the gearbox but without taking it apart, they can’t identify the issue. they lubricated something which helped but recently i’ve noticed the whine has become a lot worse so i had it checked by another garage who said i’d need a new gearbox.

I have now had the car for a year and 7 months but it is still under warranty. aside from the issue with the gearbox, i’ve had a faulty battery, window motor break, faulty spark plugs all within a year of having the car so this isn’t my first issue.

Would anyone know if i am able to argue this with VW to try and have the car repaired under warranty? the only exclusion i can see on the warranty booklet is that the car cannot be repaired for “clutch frictional materials”. The car is 2015 1.2 TSI and has done 88K miles. Thanks!

Yes of course. Two years of warranty means you should be helped with such an issue. The clutch is a wear part, just like things like tires, brake pads/discs etc.
But a gearbox should work well and without any worrying sounds coming from it. And you're a lot stronger with a second opinion from an independent workshop.

So you have a whine noise only in 5th gear ?

Try to keep the same speed on your speed and change the gear 5-4 4-3.
By doing that you could found the issue.

Mine is whining only in 5th at 90km/h-110km/h

In the 4th at the same speed, nothing. So for me it's the bearing of the 5th gear. But it's whining since 56000 km, and the car has now 111000 km.

maybe adding a thicker circlip behind the bearing like on some other vw transmitions?

To be honest I don't know.

Maybye the circlips is f**k or the bearing or the gears them self.

I did a oil replacement 6 months ago, and nothing change except the fact the gear shift is lot of smoother.

I travel to work via a dual carriageway and i find that when going into 1-3 after being sat in 5th, this is when i get the whine. Sometimes it can be extremely loud that people outside of the car can hear it and it sounds more of a bearing grinding sound than a whine but it is so inconsistent which is why the garage previously just left it as is. It is booked in with VW next week for a diagnostic so fingers crossed it will be covered.
